
In the case of v. Illinois Caballes, how they are governed? Does anyone remember?
So I'm reading online through some of the Court decisions and I think going through all of them, some people do not have their facts straight. I know he was stopped by a traffic stop routine, and that was about to go free when another officer came with his canine dog and the dog alerted them of the drug he had in his truck. Caballes was sentenced to 12 years jail time and a fine. But he went and got his case heard by the Court of Appeal saying it violated Amendment 4. That I do. Now the Court ruled in favor of horses or against it? Do you allow the aspiration to be pampered dog or what? I read in some places that did not violate the Amendment 4 because was an exterior canine sniff … so … allowing in this case or not? so lost and confused … Help … Anyone !?!?!?
The Court of Illinois appellate court overturned the original decision, ruling that the dog sniff was illegal. On appeal by the State, the U.S. Supreme Court reversed and concluded by majority (with the disagreement of opinions), that the dog sniff was legal and not violate the rights of the driver.
